Please read these Terms of Service ("Terms") carefully before using the Break Builder mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Break Builder ("we", "our", or "us"). By creating an account or using any part of the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.
2. Description of Service
Break Builder is a snooker training and match tracking application that allows users to:
- Record and review match results and statistics
- Track practice sessions and drill performance
- Access structured practice drills and training guides
- View performance analytics and progress over time
- Receive AI-powered coaching tips and advice
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.
3. User Accounts
3.1 Registration
To use the App, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at support@breakbuilder.co.
3.3 One Account Per Person
Each user may maintain only one active account. Creating multiple accounts is prohibited.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorised access to any part of the App or its infrastructure
- Reverse engineer, decompile, or disassemble the App
- Transmit any unsolicited or unauthorised advertising or promotional material
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
- Use automated scripts or bots to interact with the App
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
5. User-Generated Content
You retain ownership of any content you create within the App (match records, practice data, notes, etc.). By using the App, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the App's services to you.
You are solely responsible for the accuracy of any content you enter into the App.
6. Intellectual Property
The App, including its design, features, graphics, logos, and underlying code, is owned by Break Builder and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.
The drill content, coaching tips, and training materials within the App are proprietary to Break Builder and may not be copied, distributed, or reproduced without permission.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
8. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted, error-free, or free of viruses
- Warranties regarding the accuracy or completeness of any content within the App
The coaching tips and training advice provided within the App, including AI-generated content, are for informational and entertainment purposes only and do not constitute professional sports coaching advice.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Break Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or interruption of service.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid to us in the twelve months preceding the claim (or, if the App is free, zero).
10. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine to be harmful to the App or other users.
You may delete your account at any time from within the App's settings. Upon account deletion, your personal data will be removed as described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, through a notice within the App. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
